One Of Three Park City Graduates Enters Plea In Harassment Case

A recent Park City High School graduate – one of three charged with harassing another student in a weight-lifting class—has entered a guilty plea, in abeyance, in exchange for a reduced charge.

The defendant, 18-year-old Bernhardt Pederson, entered the plea in Third District Court Monday morning.

Under the plea agreement, Pederson is pleading to one count of Disorderly Conduct, a Class B Misdemeanor. He was originally charged with Sexual Battery.

His defense attorney, Greg Skordas, told KPCW they were willing to go to trial, but that likely wouldn’t happen until next December or January, and his client needs to go to college.

The county agreed to amend the allegation against Pederson. Skordas read the charge to the court.

"On May 2nd this year at a high school here in Summit County, Beau was in a weight room with other individuals. There was a gentleman who was working out on a bench and Beau placed his foot on the bench, in a matter that individual felt threatened because it was literally inches from his groin that also intimidated the young man." Skordas said.

The plea in abeyance stipulates that if the defendant meets the condition of the agreement within 12 months, the charge will be dismissed.

Judge Kent Holmberg ordered that Pederson pay $300 – which he will do immediately, said Skordas. He also has to perform 25 hours of community service within two months; write a two-page note on the effects of bullying, within a month; write a letter of apology to the victim in the next two weeks to go to the prosecution, and have no contact with the victim.

The other youths, both 18-years-old were also scheduled in court Monday. The attorney for Carter Hall said they have a disposition set with the county, and his case was continued to next Monday the 16th. Joseph Lukrich also had his case continued, due to his attorney having a schedule conflict Monday.
