Hideout Court Ruling Delayed

A ruling expected Monday morning in Fourth District Court on Hideout Town’s annexation into Summit County has been delayed for a day.  

Judge Jennifer Brown called in sick, according to her court clerk, who said they got the word late Sunday night.   

The hearing has been re-scheduled for 4:30 on Tuesday.   That’s the same day that Hideout’s citizens will conclude a referendum vote on the town’s annexation of some 350 acres near Richardson Flat.  Although occurring on the same day, the court hearing and the vote are not legally related to each other.

Earlier this month, the Judge heard opposing motions from Summit County and from Hideout, each asking for Summary Judgment in their favor.

The county had argued in its lawsuit that while the Hideout Town Council voted to annex last October, they didn’t complete the legal process to authorize the annexation before a crucial deadline.

Meanwhile, Hideout’s attorney argued that the county doesn’t have the standing or the legal authority to bring the lawsuit.
