The defendant, 39-year-old Lindsey Hintz, is facing three counts of Cruelty to an Animal, Reckless or Negligent. The charges are Class C misdemeanors. Her most recent court appearance was on Tuesday.
The Summit County Sheriff’s Office reported in late August that people were complaining on social media that when they were recreating with their dogs on the trails, a runner was kicking the animals and throwing rocks at them.
When deputies contacted Hintz, she said that dog owners were not obeying the leash law. She said she had been bitten by dogs before and is terrified of them. However, residents said their dogs were not being aggressive and in some cases were attacked while on-leash.
Hintz was charged in mid-September. Shortly afterward, her attorney Jarom Bangerter entered a Not Guilty plea on her behalf.
A pre-trial conference was scheduled for Tuesday, but Bangerter asked for a continuance. He said there is new video evidence obtained from the prosecution that he wants to review, and he wants to provide evidence to the county, which he said could change the course of the case.
Justice Court Judge Shauna Kerr granted a continuance until December 7th.
