Defense Pushes to Overturn Verdict in Bartender Murder Case

The attorneys for James Enoch Henfling have filed a motion asking the Third District Court to set aside the Guilty verdict that a jury passed against him nearly two months ago. The defense counsel and the Summit County Attorney's office are set to go to a court hearing Wednesday afternoon to present arguments.

Henfling's attorneys claim that before he was convicted for shooting local bartender Jose Fernandez, the jury was given instructions that were confusing, inaccurate, and prejudicial. But the County Attorney's office has said that the defense was aware of the instructions for weeks in advance and did not object to them. Rick Brough has more.
