UPDATE: Assistant Park City Manager Matt Dias told KPCW the city had no further statement on the resolution of the McLean case. The city he says continues to review the Plea in Abeyance information in accordance with city policy. Polly McLean remains on unpaid leave.
Outdoorsman and extreme skier Andrew McLean has pled Guilty, and his wife, Assistant Park City Attorney Polly McLean, has pled No Contest, on charges relating to their arrest earlier this year for absconding with hunting equipment.
The couple entered into a Plea in Abeyance agreement with prosecutors last week in Salt Lake’s Third District Court.
The charges against the par said that on September 1st, hunter Sheldon “Skip” Roberts found that hunting equipment he had installed in the woods had been stolen, including tree stands and a trail cam. Another trail cam showed the McLeans in the area.
Officers found the equipment later, after searching the McLeans two homes in Summit Park and Lambs Canyon.
A Plea in Abeyance means that if they meet the terms and conditions of a Probation Period, their convictions will be dismissed.
According to court documents from Salt Lake, 57-year-old Andrew McLean pled Guilty to a Theft charge, a Class A Misdemeanor, admitting he stole equipment valued at $500 from the owner. A Criminal Mischief charge was dismissed.
The Plea arrangement for 49-year-old Polly B. McLean was the reverse. She plead to the Criminal Mischief charge, a Class A Misdemeanor, admitting that she was present when a lock was cut on Roberts’ hunting equipment. A Theft charge for Polly was dismissed.
Other than that, the terms of the Plea Agreements are nearly the same. Both McLeans have a probation period for 12 months.
They must each perform 50 hours of Community Service and pay a fee of $1,500 over the span of nearly a year. They were also called to pay $180 plus interest as restitution to Roberts last Friday, and they’re required to violate no laws during their probation.
