The latest ruling from Third District Court is a mixed bag for the two sides in the Park City ski resort fight, as Judge Ryan Harris ruled in part for the Park City Mountain Resort and partly for Talisker - the landlord for the bulk of the Mountain Resort's ski hill.
Favoring Talisker, the judge refused to throw out its claim that the Mountain Resort is unlawfully in possession of the ski mountain, and is subject to eviction. Talisker can continue to litigate that allegation.
On the other hand, the judge turned down, Talisker's claim that it can recover the profits the Mountain Resort has made, since the time it's lease on the ski hill allegedly expired in the spring of 2011. Rick Brough has more.
