A Utah man has filed a lawsuit in Third District Court against actress Gwyneth Paltrow, Deer Valley, and an instructor at the resort in connection to a collision at the resort in 2016.

The lawsuit was filed on Tuesday by Utah resident Terry Sanderson. The lawsuit alleges that on February 26th of 2016 while skiing down the beginner rated Bandana run on Flagstaff Mountain, Paltrow ran into Sanderson knocking him down.

The suit claims that the actress was skiing out of control when she ran into Sanderson who was downhill from her. The collision caused a brain injury and four broken ribs to Sanderson. The suit alleges Paltrow then left Sanderson without signaling for help. The suit also claims a Deer Valley ski instructor who hadn’t seen the accident skied up to Sanderson and blamed the accident on him without calling for help. The suit also claims that the instructor filed a false report to protect Paltrow. The complaint alleges that the value of the damages in the case is $3.1 million.

At a press conference on Tuesday Sanderson and his attorneys said that Sanderson tried to work through different avenues with the actress and the resort before resorting to filing a lawsuit. Sanderson’s attorneys also said they had a witness who could verify Sanderson’s story.

Skiers at resorts often sign a liability waiver releasing the resort from responsibility if injury occurs as part of the inherent risk of skiing.

Sanderson’s attorneys said they are suing the resort and the instructor because they claim the instructor denied assistance to and placed blame for the collision on Sanderson.

KPCW reached out to the resort for a statement. Deer Valley said they will not comment on any pending legal matters of the resort or its guests.

Heather Wilson a spokesperson for Paltrow told KPCW that “This lawsuit is completely without merit, anyone who reads the facts will realize that.”
